Orders

All orders that you place on this website will be subject to acceptance in accordance with these terms and conditions.

Acceptance of your order and the completion of the contract between you and us will take place on dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it (please refer to our “Returns and Refunds” policy).

MACnSAM Ltd shall be under no liability for any delay or failure to deliver the products within estimated timescales. Risk of loss and damage of products passes to you on the date when the products are delivered or on the date of first attempted delivery by us.

In the unlikely event that an order is lost, damaged, delayed or faulty we won’t be able to cover for any damages or losses beyond that of replacing the goods. Please let us know of any problem, as soon as you become concerned and within 24 hours of delivery for damage or faulty goods.

If you leave instructions for the courier about where to leave a parcel if you are not at home without signing for it you immediately waive your right to compensation if the item is damaged or stolen as it isn’t possible to guarantee its integrity after delivery.

Payment

We take payment from your card at the time we receive your order, once we have checked your card details and stock availability. Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.

To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.

The price you pay is the price displayed on this website at the time we receive your order.

While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Title to any products you order on this website shall pass to you on delivery of the products provided that we have processed and received payment in full for the products. All prices are shown in £ sterling.

CASH ON DELIVERY (COD)

We are always looking for ways to make shopping easier for our customers. That is why we are introducing Cash On Delivery as a payment method for Swindon customers.

With COD, the payment for your order is made on delivery rather than in advance. This means that you must be physically present at the delivery address to finalise the transaction.

It’s simple, just hand over the cash and collect your order from the delivery driver.

The minimum order value for Cash On Delivery orders is £20, which means that your order must meet this amount to qualify for COD.

The maximum order value for Cash On Delivery is £150. (This may be increased in the future)

COD is available to only Swindon (UK) Customers. We will only accept cash for COD payments.

MACnSAM will not allow you to open the package before the payment is made. Should you wish to return the package, you will need to inform us after receiving the goods. You will then be required to return the package as per our usual return policy.

Should you fail to make payment to the driver, or if no one is there to accept the parcel, the courier will attempt redelivery up to a maximum of two times. After this period, the goods will be returned to us.

In such events whereupon the parcel is returned to us, including a change of mind or refusing to accept delivery, COD may be disabled for your account. This means that we will no longer accept COD orders from you in the future.

We are always looking for ways to improve our service, and we hope that this exciting new development will enhance your shopping experience with us even further.

Out of stocks

If in the unfortunate event an item is out of stock once you have placed your order, we will contact you to arrange a refund. We will try every possible way to fulfil and deliver in full but in certain circumstances we depend totally on our suppliers from where we dropship the orders.

Delivery:

We offer a few different types of delivery service to our most valued customers. Our Express delivery charges will be refunded if we do not adhere to the given 36hours time frame from orders placed to Swindon Customers only.

We do not provide Express delivery service to UK customers other than Swindon Locals within 5miles radius from Swindon Town Centre. For more information please look at Delivery & Collections.

Click & Collect

We welcome customers for next day collections Monday to Saturday after 1200noon from 450, Ferndale Road, Swindon, SN2 1HW. Minimum order quantity(MOQ) of £20 apply for click & collect. MACnSAM have the right to cancel any orders if below the minimum threshold. Refund of your payments will be processed as per Refund Policy. Subject to stock availability for next day collections*. Please do contact us on our website WhatsApp number or Call/WhatsApp on: +44 7424588307 before planning to come for collections. We will not be liable for your transport cost if your order is not processed or not available without you contacting or getting confirmation from MACnSAM Ltd, but if feasible we will try and fulfil your order ASAP, as we do not hold all our stock at our registered Office, most of our stock is stored at 3^rd party Warehouses. Subject to stock availability*.

Pictures of products:

Pictures on our website may differ to actual products delivered. We intend to update pictures often but in some instances you might have the same product with different packaging.

The Consumer Contract Regulations 2013

The Consumer Contract Regulations 2013 are designed to protect customers who are not physically present with the seller at the time of purchase. If you have ordered by telephone or internet, under the Consumer Contract Regulations 2013, you have a statutory right to cancel your order and receive a full refund for any home delivery item (excluding those ordered in-store). This does not apply to, items that due to their nature cannot be returned; perishable goods (e.g. food, flowers and periodicals/magazines), items personalised or made to your specification; audio/video recordings or software that you have unsealed; As such under the regulation once an order has been dispatched cancellation or refund policy doesn’t apply as we only supply perishable goods.

Amendments

We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.

Registration

Certain website services will require registration and subsequent access to those services will be subject to an approved login name and password (“Password Details”). Information that you provide on this website must be accurate and complete. All Passwords Details are accepted and may be withdrawn at our sole discretion and are exclusive to you and non-transferable and must be treated as strictly confidential at all times. At MACnSAM, we do everything we can to make sure the information about the products we sell is always as accurate as possible. However, because products are regularly improved, the product information, ingredients, nutritional guides and dietary or allergy advice may occasionally change. As a result, we recommend that you always read the label carefully before using or consuming any products. Please do not solely rely on the information provided on this website because of this, MACnSAM is unable to accept liability for any inaccuracies or incorrect information contained on this site. This does not affect your statutory rights. This information is supplied for personal use only. It must not be reproduced in any way whatsoever without the prior consent of MACnSAM, nor without due acknowledgement.
